Opinion
We think this ease was correctly decided by the Special Term, and that the judgment should be affirmed substantially upon the opinion of Van Brunt, J.
We may add that we concur in the views expressed by Mr. Butler in the careful and judicious opinion furnished by him to the board prior to the commencement of the present proceedings.
Judgment affirmed, with costs.
