Opinion

In a habeas corpus proceeding, relator appeals from a judgment of the Supreme Court, Dutchess County, entered December 5, 1962, which dismissed the writ and remanded him to respondent’s custody. Judgment affirmed, without costs. (People ex rel. Emanuel v. McMann, 7 N Y 2d 342; People ex rel. Cuomo v. Fay, 12 A D 2d 976.)
