Opinion

In a habeas corpus proceeding, relator appeals from a putative judgment of the Supreme Court, Dutchess County, which his notice of appeal states was dated October 17, 1969. Appeal dismissed. Ho judgment was entered. A decision was rendered, dated October 30, 1969, for dismissal of the writ. Ho appeal lies from a decision. However, were an appeal from the determination properly before us we would have affirmed. Christ, P. J., Rabin, Hopkins, Munder and Brennan, JJ., concur.
