The petition alleges, and there is no" dispute of fact, that by chapter 6 of the revised ordinances of 1880 of the mayor, aldermen and commonalty of the city of Hew York, which, in accordance with the provisions of section 41 of the revised charter (Laws of 1901, chap. 466) were in force on the 21st day of April, 1903, it was provided as follows
