— Upon agreed statement of facts, judgment directed for plaintiffs, without costs. In our opinion, under section 48 of the Village Law, as amended by Laws of 1927, chapter 650, plaintiffs are now lawfully holding office. Lazansky, P. J., Carswell, Seudder and Tompkins, JJ., concur; Davis, J., dissents.
