Penney v. Penney
Opinion
OPINION
This case involves a challenge to the finding of fact of the trial court that a small building on the property located at 36th Avenue and Spenard Road was not a trade fixture and as such was subject to a supplemental property division ordered by the court.1 Appellant contended the building was a trade fixture owned by Penney Sales, Inc., and thus was not subject to property division2 in the divorce of the parties.
We have reviewed the record herein and find that the findings of the trial court3 were not clearly erroneous. 4 The decision of the trial court is affirmed.5
