IT IS ORDERED:

1. Plaintiffs motion to consolidate this action with Pearsall v. Tribal Council, et al, Case No. C-03-04-001 is denied.

2. Plaintiffs motion to strike or disregard untimely motions by defendants Rei-bach and Haller is denied.

3. Plaintiffs motion for leave to file rejoinder memorandum opposing motions to dismiss is denied.

4. Defendants Reibach’s and Haller’s motions for sanctions are denied.
