Opinion
In an action for divorce, the defendant husband appeals from an order of the Supreme Court, Nassau County, dated December 20, 1976, which denied his motion to direct plaintiff to permit him to resume occupancy of the marital home and awarded plaintiff a counsel fee. Order affirmed, without costs or disbursements. The record amply supports the determination of Special Term. Martuscello, Acting P. J., Cohalan, Rabin and Mollen, JJ., concur.
