By order filed March 28, 2023, plaintiff’s complaint was dismissed, and thirty days leave to file an amended complaint was granted.1 On April 24, 2023, plaintiff’s motion for extension of time was granted, and he was given thirty days to file an amended complaint that complies with the March 28, 2023 order. (ECF No. 16.) Thirty days from that date have passed, and plaintiff has not filed an amended complaint, or otherwise responded to the court’s order. In accordance with the above, IT IS HEREBY ORDERED that the Clerk of the Court is directed to assign a district judge to this case; and IT IS RECOMMENDED that this action be dismissed without prejudice. See Local Rule 110; Fed. R. Civ. P. 41(b). //// 1 Plaintiff’s claims against defendant West were severed and proceed in Case No. 2:22-cv-2015 KJN P (E.D. Cal.) ] These findings and recommendations are submitted to the United States District Judge assigned to the case, pursuant to the provisions of 28 U.S.C. § 636(b)(1).
