District Court, E.D. California·Decided June 6, 2025·No. 2:24-cv-03338·Unknown

Opinion

RAYON JONES, No. 2:24-cv-3338 DJC CSK P Plaintiff, v. ORDER ROB BONTA, et al., Defendants. Plaintiff, a state prisoner proceeding pro se, filed this civil rights action seeking relief under 42 U.S.C. § 1983. The matter was referred to a United States Magistrate Judge pursuant to 28 U.S.C. § 636(b)(1)(B) and Local Rule 302. On April 21, 2025, the Magistrate Judge filed findings and recommendations herein which were served on Plaintiff and which contained notice to Plaintiff that any objections to the findings and recommendations were to be filed within fourteen days. Plaintiff has not filed objections to the findings and recommendations. The Court has reviewed the file and finds the findings and recommendations to be supported by the record and by the Magistrate Judge’s analysis. In addition, the Court has reviewed the Magistrate Judge’s December 6, 2024 Order (ECF No. 10) which the Court finds is also supported by the record and the proper analysis. Finally, having considered the factors described in Ferdik v. Bonzelet, 963 F.2d 1258, 1260 (9th Cir. 1992) the Court finds that dismissal is appropriate. Accordingly, IT IS HEREBY ORDERED that: 1. The findings and recommendations (ECF No. 13) are adopted in full; and 2. This action is dismissed without prejudice. See Local Rule 110; Fed. R. Civ. P.41(b); and 3. The Clerk of the Court is directed to close this case. Dated: _June 6, 2025 “Daal J CoO □□□□ Hon. Daniel alabretta UNITED STATES DISTRICT JUDGE 13. jone2dev3338.800
