ORDER AND FINDINGS AND RECOMMENDATIONS 14 ANNE WALTON, 15 Defendant. 16 17 Plaintiff is a state prisoner proceeding pro se. Plaintiff’s complaint was filed with the 18 court on November 8, 2024. Plaintiff alleges that defendant Walton altered transcripts of 19 plaintiff’s confidential Marsden hearing on March 1, 2021. (ECF No. 1 at 3.) The Court’s own 20 records reveal that on October 31, 2024, plaintiff filed a complaint in a separate action alleging 21 that defendant Anne Walton altered transcripts of plaintiff’s confidential Marsden hearing on 22 March 1, 2021. Azevedo v. Nelson, No. 2:24-cv-2995 AC (E.D. Cal.) (ECF No. 1 at 7).1 Due to 23 the duplicative nature of the present action, the Court recommends that the complaint be 24 dismissed. 25 Accordingly, IT IS HEREBY ORDERED that the Clerk of the Court is directed to assign 26 a district judge to this case; and 27 1 A court may take judicial notice of court records. Within fourteen days after being served 5 || with these findings and recommendations, plaintiff may file written objections with the court. 6 || The document should be captioned “Objections to Magistrate Judge’s Findings and 7 || Recommendations.” Plaintiff is advised that failure to file objections within the specified time 8 || may waive the right to appeal the District Court’s order.
