ON REMAND FROM THE ALABAMA SUPREME COURT

COBB, Judge.

The judgment is reversed and this cause is remanded to the trial court on the authority of Ex parte Pardue, 661 So.2d 268 (Ala.1994).

REVERSED AND REMANDED.
