Opinion

Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Washington County) to review a determination of respondent which found petitioner guilty of violating certain prison disciplinary rules.

Following an incident during which petitioner, a prison inmate, turned abruptly towards correction officers while being frisked, he was served with a misbehavior report .charging him with refusing to obey a direct order, attempted assault on staff and a movement regulation violation. Following a tier III [1021]*1021disciplinary hearing, petitioner was found guilty of the first two charges and not guilty of the movement violation. His administrative appeal proved unavailing, and he thereafter commenced this CPLR article 78 proceeding to challenge the determination.
