ON REMAND FROM THE ALABAMA SUPREME COURT

TYSON, Judge.

On authority of Ex parte Owen, 586 So.2d 963 (Ala.1991), this cause is reversed and remanded to the Circuit Court of Mobile County.

REVERSED AND REMANDED.
