The question in this case is the same as that decided by us in case of The People ex rel. Oakley v. Bleckwenn, upon the argument of which this appeal was submitted.

The judgment here appealed from should, therefore, be affirmed, with costs to the respondents.

All concur, exeept Andrews,'J., not voting, and Earl, J., dissenting.
