Opinion

Memorandum: Upon the record before us, there is ample evidence to sustain defendant’s contention that he was acting in good faith in his official capacity as Mayor of the City of Syracuse in discharging plaintiff from his position as tenant relations officer at the Mattydale Air Base. All concur. (The judgment dismisses the complaint in an action for damages for alleged malicious discharge from employment.) Present — Taylor, P. J., McCurn, Love, Yaughan and Kimball, JJ.
