Opinion

In an action to recover damages for personal injuries, plaintiff appeals from a judgment of the Supreme Court, Orange County, entered June 10, 1975, which dismissed the complaint at the close of the evidence, at a jury trial. Judgment affirmed, with costs. Under the circumstances of this case, the dismissal was proper. Hopkins, Acting P. J., Margett, Rabin, Shapiro and Hawkins, JJ., concur.
