Murphy v. Fidelity & Casualty Co.

167 So. 2d 664, 246 La. 832, 1964 La. LEXIS 2709
Supreme Court of Louisiana·Decided October 7, 1964·No. No. 47390·Published

Opinion

In re: Fidelity and Casualty Company of New York applying for certiorari, or [833] writ of review, to the Court of Appeal, Second Circuit, Parish of Bienville. 165 So.2d 497.

Writ refused. On the facts found by the Court of Appeal we find no error of law in its judgment.

McCALEB, J.; is of the opinion that a writ should be granted. SUMMERS, J., is of the opinion that the facts do not warrant the application of Article 2322 of the LSA-Civil Code and a writ should be granted.
