It appeared that French brought the action before the justice as assignee of Joel Mulford, and the justice admitted the book of accounts of Joel Mulford in evidence to support the demand; this account being a chose in action, and not assignable, and the admission of the book of Mulford inadmissible, was assigned for error; the Court without hesitation, Reversed the judgment.
