Assignee of book account may not sue as assignee.

It appeared that French brought the action before the justice as assignee of Joel Mulford, and the justice admitted the books of accounts of Joel Mulford in evidence to support the demand; this account being a chose in action, and. [55]*55not assignable, and the admission of the book of Mulford, inadmissible, was assigned for error; the court without hesitation,
