On Remand from the Alabama Supreme Court

LONG, Presiding Judge.

On the authority of Ex parte M.T.S., Jr., 778 So.2d 157 (Ala.2000), the judgment of the circuit court is reversed and this cause is remanded to. the Escambia Circuit Court for proceedings consistent with the Supreme Court’s opinion.

REVERSED AND REMANDED.

McMILLAN, COBB, BASCHAB, and FRY, JJ., concur.
