The Court is of opInu~n that, from the nature of the demand, as disclosed in the bffl~ and supported by the testimony, the case was proper for the jurisdiction of a Court of Chancery; and that therefore the decree disiuisshig the bill is erroneous. The decree is therefore reversed, with Costs, atid the cause remanded, in order to a final decree upon the incrils.-~
