Appellee has filed a motion here to dismiss this appeal for the alleged reason there has been no judgment read, signed and filed in the lower court.
The record discloses that the allegations in the motion are true and appellant in open court admitted the correctness of same. Until judgment has been signed and filed in the lower court, there was no judgment to appeal from.
It therefore follows that the appeal in this case is dismissed at appellant's cost.
