Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review a determination of respondent which revoked petitioner’s teaching certificate.
Petitioner held permanent New York State certification as a music teacher for grades 7 through 12. In February 2005, the superintendent of the district where he was employed on a probationary basis as a teacher of band and marching band advised the Department of Education that petitioner had been arrested and charged with endangering the welfare of a child.
