This matter has come before the court on the amended complaint asserting a claim under G.L.c. 93A. The court makes the following findings.

The parties entered into an agreed statement of facts originally set out as part of a joint pre-trial memorandum. This statement of facts was marked as Exhibit 3 and is attached hereto as Exhibit A.
