On defendant’s motion to dismiss and request for júdgmerit on its counterclaim, and upon failure of plaintiff to áppéar, plaintiff’s petition.was dismissed and judgment for defendant was entered nime pro tunc as of November 3d, 1953, for $28,862,28; together with interest as provided by law.
