Opinion
Claimant challenges an order of the Judge of Compensation Claims (JCC) awarding a fee in accordance with the statutory fee guideline set forth in section 440.34(1), Florida Statutes. We hold the JCC erred in relying on extra-record material in support of his finding that the petition for benefits was not for medical benefits only. Consequently, we REVERSE the order and REMAND for a fee award in the amount of $1,500.00.
