                                                     MEMORANDUM OPINION
Jody Belcher was sentenced for a conviction in Harrison County. He filed a motion for judgment nunc pro tunc requesting the trial court Âto set the record straight as to the flat time served and credited. Claiming he was denied fifty-six days of time served, he asked the trial court to Âforward a corrected copy of his time credits to the . . . Institutional Division in Huntsville, Texas. BelcherÂs pro se petition for writ of mandamus asks this Court to correct the judgment Âto reflect the appropriate time credit.ÂÂ
Unfortunately, BelcherÂs petition fails to include a record, including any judgment of conviction and the name of the trial judge. Further, there is no indication that a ruling has been made on the motion for judgment nunc pro tunc.Â
Mandamus is an extraordinary remedy that issues only to correct a clear abuse of discretion or violation of a duty imposed by law when no other adequate remedy by law is available. State v. Walker, 679 S.W.2d 484, 485 (Tex. 1984). Due to the nature of this remedy, it is BelcherÂs burden to properly request and show entitlement to the mandamus relief. See generally Walker v. Packer, 827 S.W.2d 833, 837 (Tex. 1992) (orig. proceeding); Barnes v. State
