Order reversed, with ten dollars costs and disbursements, and motion granted, upon condition that the defendant shall, within ten days, pay to plaintiff the disbursements as taxed in the judgment and ten dollars costs, otherwise the order is affirmed, with ten dollars costs and disbursements.
