PER CURIAM.

In Miller v. Kase, 789 So.2d 1095, 1096 (Fla. 4th DCA 2001), this court reversed a declaratory judgment and remanded for further proceedings. Consistent with that decision we reverse the circuit court’s April 24, 2000 order which struck the probate claim of Carole Miller and vacated the agreed order entered January 28, 1998.
