Blackford, J.

This is an action on the case brought by Keller against M’Qlemery. There are several counts in the declaration; some of them for malicious prosecution and some for slander. The plaintiff, in the counts for malicious prosecution, complains that the defendant, maliciously and without probable cause, caused him to be arrested by legal process on a charge of perjury. In the counts for slander, the words alleged to have been spoken are, that the plaintiff had, in a certain suit in this state, committed perjury; and that he was forsworn in Tennessee
