Opinion

Judgment as against appellant Heron unanimously affirmed, with costs. Judgment as against appellant Iannone reversed on the law, with costs, and complaint dismissed, with costs. In our opinion there is no proof of negligence on the part of Iannone. Lazansky, P. J., Young, Hagarty, Tompkins and Davis, JJ., concur.
