15 Plaintiff Joseph Mermelstein, proceeding pro se, appeals from a judgment
16 of the United States District Court for the Eastern District of New York (Brown, J.)
17 granting summary judgment against him on his claims against the United States
18 Department of Justice (“DOJ”) and the Federal Bureau of Investigation (“FBI”)
19 under the Freedom of Information Act (FOIA), 5 U.S.C. § 552. The District Court
20 adopted two Reports and Recommendations of the Magistrate Judge (Wicks, M.J.)
21 recommending that DOJ and the FBI be granted summary judgment, reasoning,
22 in relevant part, that the FBI had conducted an adequate search. We assume the
2 1 parties’ familiarity with the underlying facts and the record of prior proceedings,
2 to which we refer only as necessary to explain our decision to affirm.
3 “We review de novo a district court’s grant of summary judgment in FOIA
4 litigation.” Wilner v. Nat’l Sec. Agency, 592 F.3d 60, 69 (2d Cir. 2009). “[T]he
5 defending agency has the burden of showing that its search was adequate[,]” and
6 declarations showing that the agency “has conducted a thorough search . . . are
7 sufficient to sustain [this] burden.” Carney v. U.S. Dep’t of Justice, 19 F.3d 807,
8 812 (2d Cir. 1994). Agency declarations “are accorded a presumption of good
9 faith,” and a FOIA plaintiff “must make a showing of bad faith on the part of the
10 agency sufficient to impugn the agency’s affidavits or declarations or provide
11 some tangible evidence that . . . summary judgment is otherwise inappropriate.”
12 Id. (cleaned up). “This presumption cannot be rebutted by purely speculative
13 claims about the existence and discoverability of other documents.” Grand Cent.
14 P’ship, Inc. v. Cuomo, 166 F.3d 473, 489 (2d Cir. 1999) (quotation marks omitted).
15 The FBI offered sufficient evidence to demonstrate that it conducted a
16 thorough search. It submitted affidavits from Michael Seidel, section chief of the
17 Record/Information Dissemination Section of the FBI, with accompanying exhibits
3 1 including letters the parties had exchanged and a log of the documents that the
2 FBI produced. Seidel affirmed that the FBI had conducted a search of the Central
3 Records System (“CRS”), an electronic records system “where the FBI indexes
4 information about individuals, organizations, and other subjects of investigative
5 interest for future retrieval,” using multiple search indices. Gov’t Supp. App’x
6 78. Seidel further affirmed that the FBI searched the manual indices located at
7 the FBI’s headquarters and its New York and Los Angeles offices.
8 Mermelstein argues that the FBI’s search was inadequate because it did not
9 include the Electronic Surveillance Indices (“ELSUR”), a database that
10 Mermelstein contends was likely to contain additional records. But Seidel
11 asserted that “any responsive records/information within the ELSUR indices
12 would be duplicative of information available within” the CRS and explained why
13 that was so. 1 Gov’t Supp. App’x 78–79.
14 Mermelstein resists this assertion. He contends that a separate search of
1 Mermelstein cites out-of-circuit FOIA cases requiring the FBI to search ELSUR separately. See Valencia-Lucena v. U.S. Coast Guard, 180 F.3d 321 (D.C. Cir. 1999); Jett v. FBI, 139 F. Supp. 3d 352, 368 (D.D.C. 2015). Those cases are inapt because they predate the FBI’s 2015 merging of the CRS and ELSUR systems as described in Seidel’s affidavit.
4 1 ELSUR was necessary because the FBI, in an act of bad faith, “purged” the CRS of
2 certain electronic files relating to him that it still stores in ELSUR. Appellant’s Br.
3 14. Seidel affirmed that “[t]he evidence destroyed consisted of paper documents,
4 such as medical files, lawfully seized during the investigation via a search
5 warrant” and that the documents in question were disposed of pursuant to
6 standard FBI procedures. Gov’t Supp. App’x 240. Mermelstein’s claims of a
7 bad faith “purge” of electronic files, by contrast, are “purely speculative” and
8 “cannot . . . rebut[]” the presumption of good faith that attaches to Seidel’s
9 affidavits. Grand Cent., 166 F.3d at 489. Accordingly, Mermelstein neither
10 demonstrated that the FBI acted in bad faith nor rebutted Seidel’s contention that
11 a search of ELSUR would be duplicative of the search the FBI performed. He thus
12 failed to show that the FBI’s search efforts were inadequate.
13 Finally, Mermelstein contends that the District Court was obligated to
14 perform an in camera inspection of all the withheld documents. “Only if the
15 government’s affidavits make it effectively impossible for the court to conduct de
16 novo review of the applicability of FOIA exemptions is in camera review
17 necessary.” Associated Press v. U.S. Dep’t of Justice, 549 F.3d 62, 67 (2d Cir.
