In this case, which is nearly identical in the facts with the foregoing, the question of fact, whether the check was taken by the Savings Bank in absolute payment and discharge of the note of Wetter, was determined by the Court. This was error — the facts should have been left to the jury.

Judgment reversed. Nicholson.
