BAILES, Judge.

The issues in this case are identical to those in the consolidated case of Bollinger v. Republic Petroleum Corporation, this day decided by us and reported in 194 So.2d 139.

Therefore, for the reasons assigned in said consolidated case, the judgment of the trial court is reversed and there is judgment herein rejecting the demands of the plaintiff, at his costs.

Reversed.
