Opinion

PER CURIAM.

We grant Jarius McTaggart’s petition for writ of mandamus to compel the trial court to rule on McTaggart’s motion for post-conviction relief filed on or about December 23, 2003. The trial court shall entertain no further delays in scheduling a hearing on the motion and shall expedite rendition of an order granting or denying post-conviction relief accordingly.

As we are certain that the lower court will comply, we withhold issuance of the formal writ at this time.
