Appeal [1160] from a judgment of the Supreme Court (Melkonian, J.), entered February 3, 2014 in Albany County, which dismissed petitioner’s application, in a proceeding pursuant to CPLR article 78, to review a determination of respondent denying petitioner’s request for parol release.
Petitioner was convicted in 1984 of murder in the second degree (two counts) and attempted sodomy in the first degree and is currently serving an aggregate prison sentence of 25 years to life. In September 2012, petitioner made his third appearance before respondent, and his request for release was ultimately denied.
