Opinion

To vacate an order forfeiting a recognizance and ordering relator’s re-arrest, where be bad been taken before a justice upon ■complaint for assault and battery and convicted, and on appeal to tbe Circuit Court bad been required to enter into a recognizance for bis appearance, and relator insisted that tbe justice bad no authority to require tbe recognizance and that tbe Circuit Court was without jurisdiction in tbe matter. *

Order to show cause denied June 11, 1896.
