WILLIAMS, Judge.

Plaintiff-appellant, McLemore Brothers, having neither appeared nor filed a brief prior to the date fixed for the submission of this case, the appeal is considered abandoned, and is dismissed. Rule VII, Sec. 5(b), Uniform Rules of the Courts of Appeal, 8 LSA-R.S. p. 60 Pocket Parts; Sorey v. Coolidge, 197 So.2d 393 (La.App., 2d Cir. 1967).

Plaintiff-appellant is assessed with the costs of this appeal.

Appeal dismissed.
