Concur: Chief Judge Desmond and Judges Dye, Fuld, Burke, Scileppi and Bergan. Judge Van Voorhis dissents and votes to reverse the order and to dismiss the complaint upon the ground that there is no evidence of causative negligence on the part of defendant.
