Dearborn, 109 Mass. 130, was under consideration by the court at the time this was argued; that case having been held under advisement for a long time, and delayed in part for the sake of the aid that might be derived from the argument in this. The decision in that case disposes of this; and there must be a Decree for the plaintiffs.
