Per Curiam.

— It was stipulated by tbe parties to tbe above entitled action that it should be disposed of in accordance with tbe decision that should be rendered in tbe case of Monk v. Ballard, ante p. 35, 84 Pac. 397. Hence, tbe judgment of tbe honorable superior court will be reversed, with instructions to enter judgment for appellant
