DENNIS, J., would grant the writ.
DIXON, C.J., and LEMMON, J., agree that the writ should be denied. The Court of Appeal, 436 So.2d 726, was probably in error on the jury question, but relator makes no showing that the Court of Appeal was wrong on the merits.
