Opinion
Order denying defendant’s motion to dismiss the complaint for insufficiency and for judgment on the pleadings affirmed, without costs. The court is of opinion that the questions of law raised by appellant should await determination until after all facts are elicited upon a trial. Lazansky, P. J., Rich, Kapper, Hagarty and Scudder, JJ.. concur.
