Opinion

The Chief Justice

delivered the opinion of the court.

The only question in this case, is the same as that which occurred in the case of Baird, &c. vs. Rowan, &c. and for the reasons and upon the principles therein stated, the decision of the circuit Court is erroneous.

The judgment reversed with cost, and the cause remanded for a new trial to be had.
