Opinion

Savage, C. J.

Writ of entry to recover a tract of land in Fort Kent. The case has been before this court once before on exceptions to the direction of a verdict for the defendant. The court held that there was at least prima facie evidence that the plaintiff had title to the disputed strip or to some part of it. May v. Labbe, 112 Maine, 209. Upon a second trial the jury found for the defendant. And the case comes up on plaintiff’s motion for a new trial and exceptions.

The plaintiff owns the westerly part of Lot 18, south of the St. Francis road so called, and the defendant the easterly part. Their lands adjoin. The controversy relates to the location of the dividing line. The situation is shown approximately upon the following sketch:
