MEMORANDUM

PROCTOR, J.

I think the declaration is insufficient in its failure to allege any facts to show that the plaintiff was a guest in an automobile which at the time was being used by or in the business of defendant, or under its control, and that plaintiff became a guest in the car by authority or assent eminating actually or constructively from the defendant. Demurrer is sustained.
