Statement Regarding Oral Argument

Oral Argument is Requested and would assist the Court in resolving the conflict in the lower courts and in answering any questions the Court has.

Statement of the Case

Pursuant to Tex.R.App.Pro. 68.4(d), the following is a brief general statement of the

case:

Petitioner, Eddie Matthews, was charged by indictment with the offense of continuous sexual abuse of a child, a felony, in Cause No. 13,992 in the 21 st District Court of Bastrop County, Texas. He was convicted in said cause and was sentenced to 50 years incarceration. The Court of Appeals held that there was no outside influence.

Statement of Procedural History Pursuant to Tex.R.App.Pro. 68.1(d), Petitioner would show the following:

The Third Court of Appeals denied Petitioner’s appeal on December 23, 2014.

The Third Court of Appeals has decided an important question of state and federal law that has not been, but should be, settled by this Court. The Third Court of Appeals has misapplied a statute in deciding this case; and,
