before the Honorable Nelson Stephen Roman at the United States Courthouse, 300 Quarropas Street, in White Plains, New York on a date and at a time designated by the Court, for an order granting the Moving Defendants’ Motion to Dismiss pursuant to Rule 41(b) of the Federal Rules of Civil Procedure on the grounds that the Plaintiff has failed to comply with the deposition requirement and stated that he wants to withdraw his lawsuit, and for such other and further relief as this Court deems just and proper.
