ALITO,AJ., , J., concurring concurring LITO in judgment

SUPREME COURT OF THE UNITED STATES AMOS MAST, ET AL. v. FILLMORE COUNTY, MINNESOTA, ET AL.

ON PETITION FOR WRIT OF CERTIORARI TO THE COURT OF APPEALS OF MINNESOTA No. 20–7028. Decided July 2, 2021

The motion of petitioners for leave to proceed in forma pauperis and the petition for a writ of certiorari are granted. The judgment is vacated, and the case is remanded to the Court of Appeals of Minnesota for further consideration in light of Fulton v. Philadelphia, 593 U. S. ___ (2021).

JUSTICE ALITO, concurring in the judgment. I agree that we should vacate the judgment below and remand for further consideration. The lower court plainly misinterpreted and misapplied the Religious Land Use and Institutionalized Persons Act.
