Pay and allowances; retired Army pay. On a stipulation by the parties based on the decisions in Capps v. United States, 133 C. Cls. 811; Loeb v. United States, 133 C. Cls. 937, and Berzoff v. United States, 137 C. Cls. 817, and a report by the commissioner as to the amount due plaintiff, judgment for plaintiff was entered for $40,014.31.
